1. Agreement to These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and CribNosh Ltd ("CribNosh", "we", "us", or "our"), a company registered in Scotland under company number SC834534.

These Terms apply when you access or use our website, mobile applications, social and community features, ordering tools, creator tools, driver tools, support channels, or any related services we make available from time to time (together, the "Platform").

By accessing or using the Platform, you agree to these Terms and to any other policies or rules we publish and say form part of your use of the Platform, including our Privacy Policy, Community Guidelines, Cookie Policy, Refund Policy, and any creator, driver, safety, payout, or operational policies that apply to your role or use case.

If you do not agree to these Terms, you must not use the Platform.

2. Eligibility, Accounts, and Security

2.1 Age and role requirements

  • Customers must be at least 13 years old to create an account and use general customer ordering features.
  • Customers must be at least 16 years old to access social, community, or similar UGC-driven features where we require a higher minimum age.
  • Food Creators must be at least 18 years old.
  • Drivers must be at least 18 years old.
  • You must be at least the minimum age required by law to purchase any age-restricted product.

We may apply different or stricter age, verification, or eligibility rules to particular features, products, account types, or jurisdictions.

2.2 General eligibility

You must not use the Platform if:

  • applicable law prevents you from doing so;
  • we previously suspended, terminated, or otherwise disabled your access for a serious or repeated violation and have not reinstated you; or
  • you attempt to evade our account, safety, eligibility, age, verification, or enforcement controls.

2.3 Account information and security

You must provide accurate, current, and complete information, keep it up to date, and promptly correct anything inaccurate or outdated.

You are responsible for:

  • maintaining the confidentiality of your login credentials and devices;
  • all activity that occurs while your account is signed in or otherwise under your control; and
  • notifying us promptly of any suspected unauthorised access, compromise, fraud, or misuse.

3. What CribNosh Does

CribNosh is a marketplace and technology platform. We may provide ordering, payments, creator and driver tooling, family-account features, social or community features, UGC distribution, support tools, recommendations, search, discovery, moderation, safety systems, payout handling, and related operations.

CribNosh is not the preparer of food sold by Food Creators and is not, solely by operating the Platform, the employer of Food Creators or Drivers.

4. General User Rules

You must not:

  • violate law or encourage others to violate law;
  • use the Platform for illegal, fraudulent, misleading, harmful, or unauthorised purposes;
  • harass, bully, threaten, abuse, doxx, stalk, discriminate against, or impersonate another person;
  • promote or engage in hate speech, child exploitation, sexual exploitation, non-consensual sexual content, serious violence, or encouragement of self-harm;
  • upload, post, transmit, or otherwise use illegal, infringing, hateful, exploitative, deceptive, or unsafe content;
  • scrape, copy, reverse engineer, circumvent, probe, or interfere with the Platform or its security, rate limits, or access controls;
  • manipulate recommendations, discovery, reporting, compensation, rewards, reviews, or other platform systems in bad faith;
  • share phone numbers, payment details, social handles, or other contact information in order to bypass CribNosh fees, safety tools, moderation, redaction, or transaction controls;
  • use another person's account without authority; or
  • otherwise use the Platform in a way that exposes CribNosh, users, creators, drivers, partners, or the public to fraud, safety, legal, or regulatory risk.

5. Customers

If you use the Platform as a customer:

  • you may browse, order, review, save, or otherwise interact with meals, creators, community content, and related features we make available;
  • you are responsible for checking product descriptions, allergen information, ingredient information, availability, delivery details, and other information shown before placing an order;
  • you remain responsible for your own health, dietary, allergy, and suitability decisions, including where Platform information is incomplete, ambiguous, or unavailable;
  • you must not submit false issue reports, abusive refund claims, fraudulent chargebacks, or manipulated compensation requests; and
  • you must use the Platform in line with any family-account, age-gating, or account-safety controls that apply to you.

6. Family Accounts and Parent Controls

We may allow family-account or household features, including invitations, member profiles, spending limits, shared order visibility, shared payment settings, and parent or primary-account approval controls.

If you use or create a family account:

  • the primary or parent account holder is responsible for configuring family controls, permissions, and approvals;
  • the primary or parent account holder is responsible for charges, shared payment use, permissions they grant, and reasonably foreseeable activity taken through family members they authorise or retain on the account;
  • invited members may have different permissions from the primary or parent account holder;
  • we may require approval before a family member can place some orders;
  • approval requests may expire, be rejected, or become invalid if the cart, offer, applied points, delivery details, or other material checkout inputs change;
  • family membership, invitations, shared payment access, or shared order visibility may be paused, revoked, removed, declined, or expire; and
  • loss of family access may stop pending checkout, approval, or payment flows.

Nothing in these Terms requires CribNosh to guarantee that every family workflow will remain available, uninterrupted, or identical across all devices or app versions.

7. Orders, Fulfilment, and Order States

7.1 Order formation

Submitting an order request does not always mean the order is finally accepted for fulfilment. Orders may be subject to:

  • successful payment or payment authorisation;
  • creator acceptance;
  • availability;
  • safety or fraud review;
  • family approval;
  • delivery feasibility; and
  • any other eligibility or operational checks we reasonably apply.

7.2 Order lifecycle

Orders may move through one or more states, including:

  • pending;
  • confirmed;
  • preparing;
  • ready;
  • picked up;
  • in transit;
  • delivered;
  • completed;
  • cancelled;
  • refunded; and
  • exception, recovery, or other internal operational states.

Some statuses are operational, best-effort, or dependent on third-party systems, creators, drivers, or connectivity. We do not guarantee that status updates will always be instantaneous, perfectly accurate, or exhaustive.

For clarity:

  • "pending" generally means an order has been submitted but is still awaiting one or more checks, approvals, acceptance, or authorisations;
  • "confirmed" generally means the relevant creator or system has accepted the order for fulfilment, subject to later issues or exceptions;
  • "preparing" generally means the order is in active preparation;
  • "ready" generally means the creator has indicated the order is ready for pickup, handoff, or the next fulfilment step;
  • "picked up" generally means the order has been collected for delivery or handoff;
  • "in transit" generally means the order is on the way to the customer or destination;
  • "delivered" generally means the order has been handed to the customer, a permitted recipient, or the delivery location according to the order flow;
  • "completed" generally means the fulfilment flow has closed in our systems after delivery, pickup, handoff, or expiry of the relevant post-delivery handling window; and
  • "exception", "recovery", or similar states may mean there is a delivery, support, fraud, payout, technical, or operational issue under review.

Unless applicable law requires otherwise, fulfilment risk and responsibility for storage, consumption, and any post-delivery handling generally pass to the customer once the order is handed over at the delivery location, pickup point, or other agreed handoff point recorded by the Platform or the applicable fulfilment flow.

7.3 Multi-creator or segmented checkouts

Some checkouts may create separate creator order segments, parallel orders, or other grouped transactions. A problem affecting one segment or creator does not necessarily require the entire checkout to proceed, fail, or be refunded in the same way.

8. Cancellations, Failed Fulfilment, Refunds, Credits, and Points Reversals

8.1 Who may cancel

Orders may be cancelled by:

  • the customer;
  • the Food Creator;
  • the Driver where relevant to delivery assignment or fulfilment;
  • CribNosh; or
  • our systems automatically,

depending on the circumstances.

8.2 Reasons an order may be cancelled

Without limitation, an order may be cancelled where:

  • payment fails, is reversed, is not captured, is blocked, or is suspected to be fraudulent;
  • a family approval requirement is not met or expires;
  • the Food Creator declines, does not respond in time, does not begin fulfilment in time, is not ready in time, or otherwise cannot lawfully or safely fulfil the order;
  • an item, ingredient, creator, or fulfilment requirement becomes unavailable;
  • the delivery cannot safely or reasonably be completed;
  • a customer, creator, or driver reports a serious safety, legal, fraud, abuse, or compliance issue;
  • there is a mistaken, duplicate, manipulated, or otherwise invalid order flow;
  • a creator, driver, or user is suspended, restricted, or loses required eligibility;
  • a support, moderation, or legal review requires the order to be paused, cancelled, or investigated; or
  • fulfilment becomes impossible, unlawful, unsafe, or commercially unreasonable.

8.3 What happens when an order is cancelled

Depending on the order state, payment state, reason for cancellation, and whether the order is part of a segmented or grouped checkout:

  • you may receive no charge, a payment release, a reversal, a partial refund, a full refund, account credit, or another remedy we decide is appropriate under our Refund Policy and applicable law;
  • one creator segment may be cancelled while another remains active;
  • support, fraud, legal, moderation, or safety review may continue after the cancellation;
  • records, messages, proof media, and related evidence may be retained; and
  • rewards, compensation, Nosh Points, ForkPrint points, credits, or similar promotional value may be withheld, adjusted, reversed, forfeited, or corrected.

Our Refund Policy may set further rules, examples, timelines, and limits.

Any refund, reversal, payment release, or account credit may also depend on payment-provider timing, bank processing, the original payment method, fraud review, and whether funds were already captured, settled, transferred, offset, or paid out.

8.4 Delivery issues, substitutions, and support outcomes

If there is a delivery issue, creator issue, quality issue, missing-item issue, address issue, handoff issue, or other fulfilment problem:

  • you may be asked to provide notes, photos, proof, timing details, or other supporting information;
  • we may review creator, driver, customer, payout, moderation, or fraud information connected to the issue;
  • we may deny, partially grant, or fully grant the requested remedy depending on the evidence and circumstances;
  • substitutions, if offered or accepted through the Platform or otherwise permitted by the relevant order flow, remain subject to availability, safety, and applicable law; and
  • support or investigation may continue after refund, cancellation, delivery, or completion.

9. Food Creators

If you use the Platform as a Food Creator, the following terms apply in addition to the rest of these Terms.

9.1 Independent business

You are an independent business or contractor and not an employee of CribNosh. You are responsible for your own taxes, national insurance, labour arrangements, and business operations.

9.2 Food safety, lawful operation, and truthful information

You are solely responsible for:

  • lawful preparation, handling, storage, packaging, labelling, temperature control, and supply of your food;
  • allergen, ingredient, dietary, and other product information;
  • lawful operation from the premises or location you use;
  • obtaining and maintaining the registrations, licences, permissions, ratings, insurances, and approvals required for your activity;
  • truthful creator, menu, product, pricing, availability, and compliance information; and
  • keeping all evidence, documents, and records we reasonably require accurate and current.

CribNosh may require onboarding materials, declarations, certifications, readiness checks, spotchecks, premises checks, daily or session-based confirmations, corrective actions, or other operational evidence.

9.3 What Food Creators may not do

You must not:

  • sell from an unapproved or unauthorised kitchen, premises, or location;
  • go online or accept orders while blocked, suspended, or under a restriction that prevents selling;
  • provide false, incomplete, expired, unverifiable, or misleading menu, allergen, identity, document, licence, or safety information;
  • misrepresent food, ingredients, origin, certifications, kitchen status, or your identity;
  • ignore safety reviews, remediation requests, spotchecks, document requests, or investigations;
  • substitute ingredients or items in a misleading, unsafe, or unlawful way;
  • hand off food in an unsafe, unlawful, or materially non-compliant manner; or
  • circumvent CribNosh systems, communications, fees, payouts, moderation, or transaction controls.

9.4 Service and fulfilment standards

You must use reasonable endeavours to provide accurate availability, fulfil accepted orders promptly and correctly, cooperate with support and safety investigations, and maintain commercially reasonable service standards.

9.5 Creator enforcement

CribNosh may pause, restrict, reject, remove, suspend, or terminate your creator access, listings, visibility, orders, or workflows if we reasonably believe that you:

  • fail onboarding, verification, premises, subscription, safety-readiness, or document requirements;
  • breach food safety, labelling, allergen, lawful-sale, or operational requirements;
  • provide false, misleading, expired, incomplete, or unverifiable information or evidence;
  • sell from an unapproved location;
  • ignore spotchecks, corrective actions, reviews, or investigations;
  • have repeated order errors, unsafe fulfilment issues, excessive cancellations, serious customer complaints, or severe reliability failures;
  • engage in fraud, abuse, payment evasion, or off-platform circumvention; or
  • breach these Terms, our Community Guidelines, creator policies, payout policies, or other applicable Platform rules.

9.6 Effect of creator suspension or restriction

A creator restriction may, without limitation:

  • prevent you from going online;
  • stop you accepting new orders;
  • remove or reduce listing visibility;
  • disable some creator tools or seller workflows;
  • reject or pause verification;
  • hold, defer, offset, reverse, or review payouts where contractually and legally permitted; and
  • require corrective action before reinstatement.

9.7 Creator cooperation and indemnity

Food Creators must promptly cooperate with food-safety reviews, audits, complaints, chargebacks, recalls, regulator enquiries, customer claims, and legal or insurance investigations connected to their food, menus, premises, labelling, fulfilment, or conduct.

To the fullest extent permitted by law, if you act as a Food Creator, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to:

  • your food preparation, storage, packaging, transport, labelling, allergen handling, sale, or fulfilment;
  • your breach of these Terms, creator policies, safety rules, or applicable law;
  • inaccurate, false, misleading, or expired information, documents, menu details, or compliance submissions; or
  • death, injury, illness, property damage, regulatory action, or third-party claims caused by your food, business operations, or conduct.

10. Drivers

If you use the Platform as a Driver, the following terms apply in addition to the rest of these Terms.

You must:

  • hold and maintain all licences, insurances, work rights, vehicle permissions, and documents we require;
  • deliver safely, lawfully, professionally, and in line with traffic and safety laws;
  • share live or recent location information where required to operate delivery features;
  • provide proof of delivery, handoff confirmation, issue details, or supporting evidence where reasonably required;
  • cooperate with disputes, safety reviews, support investigations, and fraud-prevention processes; and
  • not misuse delivery assignment, routing, support, or customer contact tools.

We may restrict, suspend, or terminate driver access where we reasonably believe there is a safety, fraud, eligibility, legal, reliability, or conduct issue.

Drivers must not falsely mark delivery states, fabricate proof-of-delivery, misuse location permissions, hand off orders to unauthorised people where the order flow requires otherwise, or operate while suspended, disqualified, or lacking required documents or insurance.

To the fullest extent permitted by law, if you act as a Driver, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to your delivery conduct, road use, document failures, insurance failures, unlawful acts, fraud, or breach of these Terms or applicable law.

11. Fees, Payments, Payouts, and Taxes

  • Prices may include VAT or other taxes where applicable, unless we state otherwise.
  • Delivery fees, service fees, creator fees, selling access fees, adjustments, and similar charges may apply depending on the service or transaction.
  • Payments may be processed through Stripe or another provider we choose to use.
  • By placing an order or using a paid feature, you authorise us and our payment providers to charge your chosen payment method, subject to these Terms and applicable law.
  • Creator payouts and other payable amounts may be subject to deductions, offsets, chargeback recovery, refund recovery, fraud review, compliance review, taxes, fees, reserves, or other lawful adjustments.
  • We may delay, split, combine, re-route, pause, or cancel payouts where there is a failed transfer, negative balance, reserve requirement, suspected fraud, refund exposure, chargeback risk, legal issue, compliance issue, document problem, or account restriction.
  • Payout timing, settlement timing, and bank receipt timing are estimates only unless we expressly guarantee otherwise.
  • You are responsible for your own taxes, filings, and reporting where you act as a creator, driver, business user, or otherwise receive taxable amounts.

11.1 Promotions, incentives, subscriptions, and selling access

We may offer promotions, incentives, subscriptions, creator selling access, rewards, or other commercial programs. Unless we expressly say otherwise:

  • these programs may have eligibility rules, expiry dates, limits, exclusions, and anti-abuse rules;
  • we may correct, cancel, claw back, withhold, or reverse value awarded in error, through abuse, through fraud, or after a refund, reversal, or policy breach;
  • creator or seller-related access may depend on current subscription, compliance, verification, safety, or operational status; and
  • suspension, termination, or downgrade may end, pause, or change access to paid seller features, subscriptions, or program benefits without preserving prior visibility, placement, or eligibility; and
  • statutory rights available to consumers under applicable law are not excluded by these Terms.

12. Rewards, Nosh Points, ForkPrint, Calorie Tracking, and Profile Features

CribNosh may offer rewards, loyalty, profile, nutrition, calorie, habit, game, score, or progress features, including Nosh Points, ForkPrint, streaks, reminders, calorie goals, and similar metrics.

Unless we expressly say otherwise:

  • these features are informational, promotional, or engagement features only;
  • they may rely on user inputs, third-party data, internal models, or incomplete data;
  • they may be delayed, estimated, corrected, withdrawn, or changed;
  • they do not create a cash balance, stored value, or guaranteed financial right;
  • they may expire or be subject to eligibility rules; and
  • they may be withheld, reversed, cancelled, or forfeited where there is fraud, abuse, refund activity, cancellation, policy breach, or a program change.

These features do not constitute medical, dietary, nutritional, allergy, financial, or legal advice.

13. Discovery, Recommendations, Ranking, and AI Features

CribNosh may use algorithms, ranking systems, rules, signals, and AI-assisted tools to power search, recommendations, creator discovery, profile suggestions, support flows, moderation, and similar features.

These systems may take into account factors such as:

  • your profile, preferences, and past activity;
  • dietary, allergy, cuisine, location, or timing information;
  • creator availability, fulfilment, safety, and reliability signals;
  • business, quality, ranking, or experimentation signals; and
  • context from your current order, cart, or support interaction.

You agree that:

  • ranking and recommendation results are dynamic and are not guaranteed to be neutral, chronological, complete, or equal for all users or creators;
  • CribNosh does not guarantee visibility, impressions, clicks, sales, or discovery outcomes;
  • AI-generated or AI-assisted outputs may be imperfect, incomplete, or wrong; and
  • AI features do not replace professional medical, allergy, food-safety, legal, or other specialist advice.

14. Intellectual Property and User-Generated Content

14.1 Ownership

You keep ownership of content you lawfully own and submit to the Platform. CribNosh and its licensors own the Platform, brand assets, trademarks, logos, software, design, and other proprietary material, except for user-owned content.

This includes, where applicable, CribNosh-owned characters, mascots, campaign assets, generated visuals, illustrations, branded templates, interface assets, and other original Platform materials or derivative materials created for CribNosh.

14.2 What counts as content

For these Terms, "Content" includes without limitation photos, videos, recipes, stories, comments, reviews, ratings, creator profile content, menu content, live content, messages where relevant, support submissions, safety or compliance evidence, and other material you upload, post, transmit, or otherwise make available through the Platform.

14.3 Your licence to us

By submitting or making Content available on the Platform, you grant CribNosh a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, back up, format, crop, resize, translate, adapt for technical display, distribute, display, perform, moderate, review, preserve, and otherwise use that Content:

  • to operate, support, improve, secure, and protect the Platform;
  • to process orders, support requests, disputes, fraud checks, moderation, copyright reviews, and legal or regulatory obligations;
  • to power search, discovery, recommendations, ranking, and similar product features;
  • to share with service providers, infrastructure providers, payment providers, delivery partners, moderation providers, AI providers, legal advisers, insurers, auditors, regulators, and law enforcement where appropriate and lawful; and
  • to promote the Platform or its services where lawful and consistent with our policies and applicable law.

14.4 Your warranties

You represent and warrant that:

  • you own the Content or have all rights and permissions needed to submit it;
  • the Content does not infringe third-party rights;
  • the Content is not misleading, unlawful, or otherwise in breach of these Terms or our policies; and
  • any compliance, safety, or operational evidence you submit is truthful and not manipulated in a misleading way.

14.5 Restrictions on reuse

You must not copy, scrape, reproduce, republish, extract, train on, mirror, systematically collect, or otherwise exploit Platform content, data, creator listings, media, branding, mascots, or generated visual assets except as expressly permitted by us in writing or by mandatory law.

14.6 Indemnity for content and misuse

To the fullest extent permitted by law, if you submit Content, use UGC features, or otherwise use the Platform in breach of these Terms, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to your Content, your infringement of third-party rights, your unlawful use of the Platform, or your breach of these Terms.

15. Moderation, Reporting, Blocking, and Copyright

CribNosh may use automated and human moderation, ranking, detection, and safety systems to review content, behaviour, and reports.

Users may be able to report, block, mute, hide, or otherwise restrict certain content, accounts, or interactions, but we do not guarantee that every report, block, or review feature will always be available, immediate, or exhaustive.

We may:

  • remove content;
  • reduce or limit visibility or distribution;
  • restrict, mute, shadow-limit, suspend, or terminate accounts or features;
  • preserve content, metadata, and related records for safety, dispute, fraud, moderation, copyright, legal, or regulatory purposes;
  • investigate and act on reports;
  • require additional evidence or explanation; and
  • operate takedown, counter-notice, appeal, repeat-infringer, and related copyright or legal workflows.

False, abusive, retaliatory, or manipulative reports or evidence submissions may themselves be treated as violations.

We may set reasonable deadlines, evidence requirements, eligibility criteria, and process rules for reports, complaints, appeals, and counter-notices, and may decline to revisit matters that are unsupported, abusive, duplicative, untimely, or already reasonably resolved.

15.1 Copyright notices and repeat infringement

If we receive a copyright, takedown, counter-notice, appeal, or similar legal-content complaint:

  • we may remove or limit the relevant content;
  • preserve the content, related metadata, account records, and evidence;
  • notify relevant users where appropriate;
  • request additional information or declarations;
  • consider counter-notices, appeals, or other review submissions; and
  • take repeat-infringer or other escalating action where we reasonably believe repeated infringement or abuse has occurred.

15.2 Live, video, and community safety

Live sessions, videos, comments, stories, reviews, and other social or UGC-driven features may be subject to additional moderation, audience-limiting, discovery-limiting, muting, blocking, takedown, or safety controls.

16. Suspension, Termination, and Effect on Your Account

We may warn, restrict, suspend, or terminate your access to all or part of the Platform at any time where we reasonably believe:

  • you breached these Terms or another Platform policy;
  • your behaviour creates legal, safety, fraud, abuse, compliance, operational, or reputational risk;
  • we are required to do so by law, regulation, court order, governmental request, insurer requirement, or payment-provider rule; or
  • continued access is no longer commercially, technically, or operationally appropriate.

Depending on the situation, a restriction may affect:

  • your account access;
  • your ability to order, sell, deliver, post, comment, or message;
  • your content visibility or distribution;
  • active or pending orders;
  • refunds or support handling;
  • family account permissions;
  • stored credits, promotional value, loyalty balance treatment, or subscription state;
  • payouts or balances where legally and contractually permitted; and
  • your access to promotions, rewards, or community features.

Some actions may be temporary and some may be permanent. Some may have a review or appeal path and some may not.

If we terminate or restrict you for fraud, abuse, safety, or serious policy breach, we may also prevent re-registration, alternate-account creation, or circumvention attempts.

17. Support, Issue Reporting, and Investigations

CribNosh may provide support, issue-reporting, complaint, appeal, or dispute channels for orders, payouts, deliveries, content, copyright, moderation, safety, and account issues.

When you use those channels:

  • you must provide truthful and non-misleading information;
  • we may ask for supporting evidence, declarations, screenshots, photos, messages, or timestamps;
  • we may link your report to order, account, moderation, payout, or device records where relevant;
  • we may keep records of the report, its outcome, and related evidence; and
  • we may route the issue to support, trust and safety, legal, finance, operations, or a service provider where reasonably necessary.

We may close, deny, or limit a report, complaint, refund request, or appeal where we reasonably conclude that the evidence does not support the requested outcome, the request is abusive or misleading, the relevant time window has expired, the issue has already been resolved, or applicable law or policy does not require the remedy sought.

18. Data Retention and Deletion Requests

Deletion, retention, backup, and legal preservation are governed primarily by our Privacy Policy. If you request deletion of your account or content, we may still retain information for as long as reasonably necessary for:

  • fulfilment records;
  • refunds, chargebacks, and disputes;
  • fraud prevention;
  • moderation and safety reviews;
  • copyright and takedown handling;
  • legal and regulatory compliance;
  • tax and accounting;
  • platform security; and
  • backups and disaster recovery cycles.

19. Mobile App, Platform-Provider, and Feature Controls

Some Platform features, especially UGC, social, live, mapping, recommendation, creator, or driver features, may be changed, limited, age-gated, blocked, or removed to comply with app-store requirements, payment-provider rules, legal obligations, safety obligations, or operational constraints.

We do not guarantee that every feature will be available on every platform, device, version, territory, or account type.

20. Disclaimers

To the fullest extent permitted by law:

  • the Platform is provided on an "as is" and "as available" basis;
  • CribNosh does not guarantee uninterrupted availability, error-free operation, or that all statuses, recommendations, profile metrics, reports, or communications will be accurate or complete;
  • CribNosh does not guarantee that any creator food, allergen information, labels, recommendations, delivery timing, or user-generated content will always be safe, accurate, lawful, or suitable for your needs; and
  • CribNosh does not independently certify or guarantee that a Food Creator's food is safe merely because the creator uses the Platform, completes readiness steps, or submits compliance information.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for your non-excludable consumer rights.

21. Limitation of Liability

To the fullest extent permitted by law, CribNosh shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, business, or data arising out of or in connection with your use of the Platform.

Subject to the paragraph above, our total aggregate liability to you for all claims arising out of or in connection with the Platform or these Terms shall be limited to the greater of:

  • the amount of fees you paid to us in the 12 months before the event giving rise to the claim; or
  • GBP 100.

This clause does not affect mandatory consumer rights or any non-excludable statutory protections that apply to you.

22. Changes to These Terms and the Platform

We may change these Terms, the Platform, our features, fees, eligibility rules, rewards rules, creator rules, driver rules, safety requirements, moderation standards, or related policies from time to time.

Where legally required, we will provide appropriate notice of material changes. Your continued use of the Platform after a change takes effect means you accept the updated terms, except where applicable law requires another form of consent.

23. Other Important Terms

If any part of these Terms is found unenforceable, the rest will continue in effect.

If we delay enforcing a right, that does not mean we waive it.

Rights or obligations that by their nature should continue after termination will continue, including provisions on payments, disputes, liability, intellectual property, content licences, retention, moderation, fraud prevention, legal compliance, and governing law.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms, except that we may bring proceedings in another competent jurisdiction where necessary to protect our rights or enforce these Terms.

1. Agreement to These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and CribNosh Ltd ("CribNosh", "we", "us", or "our"), a company registered in Scotland under company number SC834534.

These Terms apply when you access or use our website, mobile applications, social and community features, ordering tools, creator tools, driver tools, support channels, or any related services we make available from time to time (together, the "Platform").

By accessing or using the Platform, you agree to these Terms and to any other policies or rules we publish and say form part of your use of the Platform, including our Privacy Policy, Community Guidelines, Cookie Policy, Refund Policy, and any creator, driver, safety, payout, or operational policies that apply to your role or use case.

If you do not agree to these Terms, you must not use the Platform.

2. Eligibility, Accounts, and Security

2.1 Age and role requirements

  • Customers must be at least 13 years old to create an account and use general customer ordering features.
  • Customers must be at least 16 years old to access social, community, or similar UGC-driven features where we require a higher minimum age.
  • Food Creators must be at least 18 years old.
  • Drivers must be at least 18 years old.
  • You must be at least the minimum age required by law to purchase any age-restricted product.

We may apply different or stricter age, verification, or eligibility rules to particular features, products, account types, or jurisdictions.

2.2 General eligibility

You must not use the Platform if:

  • applicable law prevents you from doing so;
  • we previously suspended, terminated, or otherwise disabled your access for a serious or repeated violation and have not reinstated you; or
  • you attempt to evade our account, safety, eligibility, age, verification, or enforcement controls.

2.3 Account information and security

You must provide accurate, current, and complete information, keep it up to date, and promptly correct anything inaccurate or outdated.

You are responsible for:

  • maintaining the confidentiality of your login credentials and devices;
  • all activity that occurs while your account is signed in or otherwise under your control; and
  • notifying us promptly of any suspected unauthorised access, compromise, fraud, or misuse.

3. What CribNosh Does

CribNosh is a marketplace and technology platform. We may provide ordering, payments, creator and driver tooling, family-account features, social or community features, UGC distribution, support tools, recommendations, search, discovery, moderation, safety systems, payout handling, and related operations.

CribNosh is not the preparer of food sold by Food Creators and is not, solely by operating the Platform, the employer of Food Creators or Drivers.

4. General User Rules

You must not:

  • violate law or encourage others to violate law;
  • use the Platform for illegal, fraudulent, misleading, harmful, or unauthorised purposes;
  • harass, bully, threaten, abuse, doxx, stalk, discriminate against, or impersonate another person;
  • promote or engage in hate speech, child exploitation, sexual exploitation, non-consensual sexual content, serious violence, or encouragement of self-harm;
  • upload, post, transmit, or otherwise use illegal, infringing, hateful, exploitative, deceptive, or unsafe content;
  • scrape, copy, reverse engineer, circumvent, probe, or interfere with the Platform or its security, rate limits, or access controls;
  • manipulate recommendations, discovery, reporting, compensation, rewards, reviews, or other platform systems in bad faith;
  • share phone numbers, payment details, social handles, or other contact information in order to bypass CribNosh fees, safety tools, moderation, redaction, or transaction controls;
  • use another person's account without authority; or
  • otherwise use the Platform in a way that exposes CribNosh, users, creators, drivers, partners, or the public to fraud, safety, legal, or regulatory risk.

5. Customers

If you use the Platform as a customer:

  • you may browse, order, review, save, or otherwise interact with meals, creators, community content, and related features we make available;
  • you are responsible for checking product descriptions, allergen information, ingredient information, availability, delivery details, and other information shown before placing an order;
  • you remain responsible for your own health, dietary, allergy, and suitability decisions, including where Platform information is incomplete, ambiguous, or unavailable;
  • you must not submit false issue reports, abusive refund claims, fraudulent chargebacks, or manipulated compensation requests; and
  • you must use the Platform in line with any family-account, age-gating, or account-safety controls that apply to you.

6. Family Accounts and Parent Controls

We may allow family-account or household features, including invitations, member profiles, spending limits, shared order visibility, shared payment settings, and parent or primary-account approval controls.

If you use or create a family account:

  • the primary or parent account holder is responsible for configuring family controls, permissions, and approvals;
  • the primary or parent account holder is responsible for charges, shared payment use, permissions they grant, and reasonably foreseeable activity taken through family members they authorise or retain on the account;
  • invited members may have different permissions from the primary or parent account holder;
  • we may require approval before a family member can place some orders;
  • approval requests may expire, be rejected, or become invalid if the cart, offer, applied points, delivery details, or other material checkout inputs change;
  • family membership, invitations, shared payment access, or shared order visibility may be paused, revoked, removed, declined, or expire; and
  • loss of family access may stop pending checkout, approval, or payment flows.

Nothing in these Terms requires CribNosh to guarantee that every family workflow will remain available, uninterrupted, or identical across all devices or app versions.

7. Orders, Fulfilment, and Order States

7.1 Order formation

Submitting an order request does not always mean the order is finally accepted for fulfilment. Orders may be subject to:

  • successful payment or payment authorisation;
  • creator acceptance;
  • availability;
  • safety or fraud review;
  • family approval;
  • delivery feasibility; and
  • any other eligibility or operational checks we reasonably apply.

7.2 Order lifecycle

Orders may move through one or more states, including:

  • pending;
  • confirmed;
  • preparing;
  • ready;
  • picked up;
  • in transit;
  • delivered;
  • completed;
  • cancelled;
  • refunded; and
  • exception, recovery, or other internal operational states.

Some statuses are operational, best-effort, or dependent on third-party systems, creators, drivers, or connectivity. We do not guarantee that status updates will always be instantaneous, perfectly accurate, or exhaustive.

For clarity:

  • "pending" generally means an order has been submitted but is still awaiting one or more checks, approvals, acceptance, or authorisations;
  • "confirmed" generally means the relevant creator or system has accepted the order for fulfilment, subject to later issues or exceptions;
  • "preparing" generally means the order is in active preparation;
  • "ready" generally means the creator has indicated the order is ready for pickup, handoff, or the next fulfilment step;
  • "picked up" generally means the order has been collected for delivery or handoff;
  • "in transit" generally means the order is on the way to the customer or destination;
  • "delivered" generally means the order has been handed to the customer, a permitted recipient, or the delivery location according to the order flow;
  • "completed" generally means the fulfilment flow has closed in our systems after delivery, pickup, handoff, or expiry of the relevant post-delivery handling window; and
  • "exception", "recovery", or similar states may mean there is a delivery, support, fraud, payout, technical, or operational issue under review.

Unless applicable law requires otherwise, fulfilment risk and responsibility for storage, consumption, and any post-delivery handling generally pass to the customer once the order is handed over at the delivery location, pickup point, or other agreed handoff point recorded by the Platform or the applicable fulfilment flow.

7.3 Multi-creator or segmented checkouts

Some checkouts may create separate creator order segments, parallel orders, or other grouped transactions. A problem affecting one segment or creator does not necessarily require the entire checkout to proceed, fail, or be refunded in the same way.

8. Cancellations, Failed Fulfilment, Refunds, Credits, and Points Reversals

8.1 Who may cancel

Orders may be cancelled by:

  • the customer;
  • the Food Creator;
  • the Driver where relevant to delivery assignment or fulfilment;
  • CribNosh; or
  • our systems automatically,

depending on the circumstances.

8.2 Reasons an order may be cancelled

Without limitation, an order may be cancelled where:

  • payment fails, is reversed, is not captured, is blocked, or is suspected to be fraudulent;
  • a family approval requirement is not met or expires;
  • the Food Creator declines, does not respond in time, does not begin fulfilment in time, is not ready in time, or otherwise cannot lawfully or safely fulfil the order;
  • an item, ingredient, creator, or fulfilment requirement becomes unavailable;
  • the delivery cannot safely or reasonably be completed;
  • a customer, creator, or driver reports a serious safety, legal, fraud, abuse, or compliance issue;
  • there is a mistaken, duplicate, manipulated, or otherwise invalid order flow;
  • a creator, driver, or user is suspended, restricted, or loses required eligibility;
  • a support, moderation, or legal review requires the order to be paused, cancelled, or investigated; or
  • fulfilment becomes impossible, unlawful, unsafe, or commercially unreasonable.

8.3 What happens when an order is cancelled

Depending on the order state, payment state, reason for cancellation, and whether the order is part of a segmented or grouped checkout:

  • you may receive no charge, a payment release, a reversal, a partial refund, a full refund, account credit, or another remedy we decide is appropriate under our Refund Policy and applicable law;
  • one creator segment may be cancelled while another remains active;
  • support, fraud, legal, moderation, or safety review may continue after the cancellation;
  • records, messages, proof media, and related evidence may be retained; and
  • rewards, compensation, Nosh Points, ForkPrint points, credits, or similar promotional value may be withheld, adjusted, reversed, forfeited, or corrected.

Our Refund Policy may set further rules, examples, timelines, and limits.

Any refund, reversal, payment release, or account credit may also depend on payment-provider timing, bank processing, the original payment method, fraud review, and whether funds were already captured, settled, transferred, offset, or paid out.

8.4 Delivery issues, substitutions, and support outcomes

If there is a delivery issue, creator issue, quality issue, missing-item issue, address issue, handoff issue, or other fulfilment problem:

  • you may be asked to provide notes, photos, proof, timing details, or other supporting information;
  • we may review creator, driver, customer, payout, moderation, or fraud information connected to the issue;
  • we may deny, partially grant, or fully grant the requested remedy depending on the evidence and circumstances;
  • substitutions, if offered or accepted through the Platform or otherwise permitted by the relevant order flow, remain subject to availability, safety, and applicable law; and
  • support or investigation may continue after refund, cancellation, delivery, or completion.

9. Food Creators

If you use the Platform as a Food Creator, the following terms apply in addition to the rest of these Terms.

9.1 Independent business

You are an independent business or contractor and not an employee of CribNosh. You are responsible for your own taxes, national insurance, labour arrangements, and business operations.

9.2 Food safety, lawful operation, and truthful information

You are solely responsible for:

  • lawful preparation, handling, storage, packaging, labelling, temperature control, and supply of your food;
  • allergen, ingredient, dietary, and other product information;
  • lawful operation from the premises or location you use;
  • obtaining and maintaining the registrations, licences, permissions, ratings, insurances, and approvals required for your activity;
  • truthful creator, menu, product, pricing, availability, and compliance information; and
  • keeping all evidence, documents, and records we reasonably require accurate and current.

CribNosh may require onboarding materials, declarations, certifications, readiness checks, spotchecks, premises checks, daily or session-based confirmations, corrective actions, or other operational evidence.

9.3 What Food Creators may not do

You must not:

  • sell from an unapproved or unauthorised kitchen, premises, or location;
  • go online or accept orders while blocked, suspended, or under a restriction that prevents selling;
  • provide false, incomplete, expired, unverifiable, or misleading menu, allergen, identity, document, licence, or safety information;
  • misrepresent food, ingredients, origin, certifications, kitchen status, or your identity;
  • ignore safety reviews, remediation requests, spotchecks, document requests, or investigations;
  • substitute ingredients or items in a misleading, unsafe, or unlawful way;
  • hand off food in an unsafe, unlawful, or materially non-compliant manner; or
  • circumvent CribNosh systems, communications, fees, payouts, moderation, or transaction controls.

9.4 Service and fulfilment standards

You must use reasonable endeavours to provide accurate availability, fulfil accepted orders promptly and correctly, cooperate with support and safety investigations, and maintain commercially reasonable service standards.

9.5 Creator enforcement

CribNosh may pause, restrict, reject, remove, suspend, or terminate your creator access, listings, visibility, orders, or workflows if we reasonably believe that you:

  • fail onboarding, verification, premises, subscription, safety-readiness, or document requirements;
  • breach food safety, labelling, allergen, lawful-sale, or operational requirements;
  • provide false, misleading, expired, incomplete, or unverifiable information or evidence;
  • sell from an unapproved location;
  • ignore spotchecks, corrective actions, reviews, or investigations;
  • have repeated order errors, unsafe fulfilment issues, excessive cancellations, serious customer complaints, or severe reliability failures;
  • engage in fraud, abuse, payment evasion, or off-platform circumvention; or
  • breach these Terms, our Community Guidelines, creator policies, payout policies, or other applicable Platform rules.

9.6 Effect of creator suspension or restriction

A creator restriction may, without limitation:

  • prevent you from going online;
  • stop you accepting new orders;
  • remove or reduce listing visibility;
  • disable some creator tools or seller workflows;
  • reject or pause verification;
  • hold, defer, offset, reverse, or review payouts where contractually and legally permitted; and
  • require corrective action before reinstatement.

9.7 Creator cooperation and indemnity

Food Creators must promptly cooperate with food-safety reviews, audits, complaints, chargebacks, recalls, regulator enquiries, customer claims, and legal or insurance investigations connected to their food, menus, premises, labelling, fulfilment, or conduct.

To the fullest extent permitted by law, if you act as a Food Creator, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to:

  • your food preparation, storage, packaging, transport, labelling, allergen handling, sale, or fulfilment;
  • your breach of these Terms, creator policies, safety rules, or applicable law;
  • inaccurate, false, misleading, or expired information, documents, menu details, or compliance submissions; or
  • death, injury, illness, property damage, regulatory action, or third-party claims caused by your food, business operations, or conduct.

10. Drivers

If you use the Platform as a Driver, the following terms apply in addition to the rest of these Terms.

You must:

  • hold and maintain all licences, insurances, work rights, vehicle permissions, and documents we require;
  • deliver safely, lawfully, professionally, and in line with traffic and safety laws;
  • share live or recent location information where required to operate delivery features;
  • provide proof of delivery, handoff confirmation, issue details, or supporting evidence where reasonably required;
  • cooperate with disputes, safety reviews, support investigations, and fraud-prevention processes; and
  • not misuse delivery assignment, routing, support, or customer contact tools.

We may restrict, suspend, or terminate driver access where we reasonably believe there is a safety, fraud, eligibility, legal, reliability, or conduct issue.

Drivers must not falsely mark delivery states, fabricate proof-of-delivery, misuse location permissions, hand off orders to unauthorised people where the order flow requires otherwise, or operate while suspended, disqualified, or lacking required documents or insurance.

To the fullest extent permitted by law, if you act as a Driver, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to your delivery conduct, road use, document failures, insurance failures, unlawful acts, fraud, or breach of these Terms or applicable law.

11. Fees, Payments, Payouts, and Taxes

  • Prices may include VAT or other taxes where applicable, unless we state otherwise.
  • Delivery fees, service fees, creator fees, selling access fees, adjustments, and similar charges may apply depending on the service or transaction.
  • Payments may be processed through Stripe or another provider we choose to use.
  • By placing an order or using a paid feature, you authorise us and our payment providers to charge your chosen payment method, subject to these Terms and applicable law.
  • Creator payouts and other payable amounts may be subject to deductions, offsets, chargeback recovery, refund recovery, fraud review, compliance review, taxes, fees, reserves, or other lawful adjustments.
  • We may delay, split, combine, re-route, pause, or cancel payouts where there is a failed transfer, negative balance, reserve requirement, suspected fraud, refund exposure, chargeback risk, legal issue, compliance issue, document problem, or account restriction.
  • Payout timing, settlement timing, and bank receipt timing are estimates only unless we expressly guarantee otherwise.
  • You are responsible for your own taxes, filings, and reporting where you act as a creator, driver, business user, or otherwise receive taxable amounts.

11.1 Promotions, incentives, subscriptions, and selling access

We may offer promotions, incentives, subscriptions, creator selling access, rewards, or other commercial programs. Unless we expressly say otherwise:

  • these programs may have eligibility rules, expiry dates, limits, exclusions, and anti-abuse rules;
  • we may correct, cancel, claw back, withhold, or reverse value awarded in error, through abuse, through fraud, or after a refund, reversal, or policy breach;
  • creator or seller-related access may depend on current subscription, compliance, verification, safety, or operational status; and
  • suspension, termination, or downgrade may end, pause, or change access to paid seller features, subscriptions, or program benefits without preserving prior visibility, placement, or eligibility; and
  • statutory rights available to consumers under applicable law are not excluded by these Terms.

12. Rewards, Nosh Points, ForkPrint, Calorie Tracking, and Profile Features

CribNosh may offer rewards, loyalty, profile, nutrition, calorie, habit, game, score, or progress features, including Nosh Points, ForkPrint, streaks, reminders, calorie goals, and similar metrics.

Unless we expressly say otherwise:

  • these features are informational, promotional, or engagement features only;
  • they may rely on user inputs, third-party data, internal models, or incomplete data;
  • they may be delayed, estimated, corrected, withdrawn, or changed;
  • they do not create a cash balance, stored value, or guaranteed financial right;
  • they may expire or be subject to eligibility rules; and
  • they may be withheld, reversed, cancelled, or forfeited where there is fraud, abuse, refund activity, cancellation, policy breach, or a program change.

These features do not constitute medical, dietary, nutritional, allergy, financial, or legal advice.

13. Discovery, Recommendations, Ranking, and AI Features

CribNosh may use algorithms, ranking systems, rules, signals, and AI-assisted tools to power search, recommendations, creator discovery, profile suggestions, support flows, moderation, and similar features.

These systems may take into account factors such as:

  • your profile, preferences, and past activity;
  • dietary, allergy, cuisine, location, or timing information;
  • creator availability, fulfilment, safety, and reliability signals;
  • business, quality, ranking, or experimentation signals; and
  • context from your current order, cart, or support interaction.

You agree that:

  • ranking and recommendation results are dynamic and are not guaranteed to be neutral, chronological, complete, or equal for all users or creators;
  • CribNosh does not guarantee visibility, impressions, clicks, sales, or discovery outcomes;
  • AI-generated or AI-assisted outputs may be imperfect, incomplete, or wrong; and
  • AI features do not replace professional medical, allergy, food-safety, legal, or other specialist advice.

14. Intellectual Property and User-Generated Content

14.1 Ownership

You keep ownership of content you lawfully own and submit to the Platform. CribNosh and its licensors own the Platform, brand assets, trademarks, logos, software, design, and other proprietary material, except for user-owned content.

This includes, where applicable, CribNosh-owned characters, mascots, campaign assets, generated visuals, illustrations, branded templates, interface assets, and other original Platform materials or derivative materials created for CribNosh.

14.2 What counts as content

For these Terms, "Content" includes without limitation photos, videos, recipes, stories, comments, reviews, ratings, creator profile content, menu content, live content, messages where relevant, support submissions, safety or compliance evidence, and other material you upload, post, transmit, or otherwise make available through the Platform.

14.3 Your licence to us

By submitting or making Content available on the Platform, you grant CribNosh a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, back up, format, crop, resize, translate, adapt for technical display, distribute, display, perform, moderate, review, preserve, and otherwise use that Content:

  • to operate, support, improve, secure, and protect the Platform;
  • to process orders, support requests, disputes, fraud checks, moderation, copyright reviews, and legal or regulatory obligations;
  • to power search, discovery, recommendations, ranking, and similar product features;
  • to share with service providers, infrastructure providers, payment providers, delivery partners, moderation providers, AI providers, legal advisers, insurers, auditors, regulators, and law enforcement where appropriate and lawful; and
  • to promote the Platform or its services where lawful and consistent with our policies and applicable law.

14.4 Your warranties

You represent and warrant that:

  • you own the Content or have all rights and permissions needed to submit it;
  • the Content does not infringe third-party rights;
  • the Content is not misleading, unlawful, or otherwise in breach of these Terms or our policies; and
  • any compliance, safety, or operational evidence you submit is truthful and not manipulated in a misleading way.

14.5 Restrictions on reuse

You must not copy, scrape, reproduce, republish, extract, train on, mirror, systematically collect, or otherwise exploit Platform content, data, creator listings, media, branding, mascots, or generated visual assets except as expressly permitted by us in writing or by mandatory law.

14.6 Indemnity for content and misuse

To the fullest extent permitted by law, if you submit Content, use UGC features, or otherwise use the Platform in breach of these Terms, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to your Content, your infringement of third-party rights, your unlawful use of the Platform, or your breach of these Terms.

15. Moderation, Reporting, Blocking, and Copyright

CribNosh may use automated and human moderation, ranking, detection, and safety systems to review content, behaviour, and reports.

Users may be able to report, block, mute, hide, or otherwise restrict certain content, accounts, or interactions, but we do not guarantee that every report, block, or review feature will always be available, immediate, or exhaustive.

We may:

  • remove content;
  • reduce or limit visibility or distribution;
  • restrict, mute, shadow-limit, suspend, or terminate accounts or features;
  • preserve content, metadata, and related records for safety, dispute, fraud, moderation, copyright, legal, or regulatory purposes;
  • investigate and act on reports;
  • require additional evidence or explanation; and
  • operate takedown, counter-notice, appeal, repeat-infringer, and related copyright or legal workflows.

False, abusive, retaliatory, or manipulative reports or evidence submissions may themselves be treated as violations.

We may set reasonable deadlines, evidence requirements, eligibility criteria, and process rules for reports, complaints, appeals, and counter-notices, and may decline to revisit matters that are unsupported, abusive, duplicative, untimely, or already reasonably resolved.

15.1 Copyright notices and repeat infringement

If we receive a copyright, takedown, counter-notice, appeal, or similar legal-content complaint:

  • we may remove or limit the relevant content;
  • preserve the content, related metadata, account records, and evidence;
  • notify relevant users where appropriate;
  • request additional information or declarations;
  • consider counter-notices, appeals, or other review submissions; and
  • take repeat-infringer or other escalating action where we reasonably believe repeated infringement or abuse has occurred.

15.2 Live, video, and community safety

Live sessions, videos, comments, stories, reviews, and other social or UGC-driven features may be subject to additional moderation, audience-limiting, discovery-limiting, muting, blocking, takedown, or safety controls.

16. Suspension, Termination, and Effect on Your Account

We may warn, restrict, suspend, or terminate your access to all or part of the Platform at any time where we reasonably believe:

  • you breached these Terms or another Platform policy;
  • your behaviour creates legal, safety, fraud, abuse, compliance, operational, or reputational risk;
  • we are required to do so by law, regulation, court order, governmental request, insurer requirement, or payment-provider rule; or
  • continued access is no longer commercially, technically, or operationally appropriate.

Depending on the situation, a restriction may affect:

  • your account access;
  • your ability to order, sell, deliver, post, comment, or message;
  • your content visibility or distribution;
  • active or pending orders;
  • refunds or support handling;
  • family account permissions;
  • stored credits, promotional value, loyalty balance treatment, or subscription state;
  • payouts or balances where legally and contractually permitted; and
  • your access to promotions, rewards, or community features.

Some actions may be temporary and some may be permanent. Some may have a review or appeal path and some may not.

If we terminate or restrict you for fraud, abuse, safety, or serious policy breach, we may also prevent re-registration, alternate-account creation, or circumvention attempts.

17. Support, Issue Reporting, and Investigations

CribNosh may provide support, issue-reporting, complaint, appeal, or dispute channels for orders, payouts, deliveries, content, copyright, moderation, safety, and account issues.

When you use those channels:

  • you must provide truthful and non-misleading information;
  • we may ask for supporting evidence, declarations, screenshots, photos, messages, or timestamps;
  • we may link your report to order, account, moderation, payout, or device records where relevant;
  • we may keep records of the report, its outcome, and related evidence; and
  • we may route the issue to support, trust and safety, legal, finance, operations, or a service provider where reasonably necessary.

We may close, deny, or limit a report, complaint, refund request, or appeal where we reasonably conclude that the evidence does not support the requested outcome, the request is abusive or misleading, the relevant time window has expired, the issue has already been resolved, or applicable law or policy does not require the remedy sought.

18. Data Retention and Deletion Requests

Deletion, retention, backup, and legal preservation are governed primarily by our Privacy Policy. If you request deletion of your account or content, we may still retain information for as long as reasonably necessary for:

  • fulfilment records;
  • refunds, chargebacks, and disputes;
  • fraud prevention;
  • moderation and safety reviews;
  • copyright and takedown handling;
  • legal and regulatory compliance;
  • tax and accounting;
  • platform security; and
  • backups and disaster recovery cycles.

19. Mobile App, Platform-Provider, and Feature Controls

Some Platform features, especially UGC, social, live, mapping, recommendation, creator, or driver features, may be changed, limited, age-gated, blocked, or removed to comply with app-store requirements, payment-provider rules, legal obligations, safety obligations, or operational constraints.

We do not guarantee that every feature will be available on every platform, device, version, territory, or account type.

20. Disclaimers

To the fullest extent permitted by law:

  • the Platform is provided on an "as is" and "as available" basis;
  • CribNosh does not guarantee uninterrupted availability, error-free operation, or that all statuses, recommendations, profile metrics, reports, or communications will be accurate or complete;
  • CribNosh does not guarantee that any creator food, allergen information, labels, recommendations, delivery timing, or user-generated content will always be safe, accurate, lawful, or suitable for your needs; and
  • CribNosh does not independently certify or guarantee that a Food Creator's food is safe merely because the creator uses the Platform, completes readiness steps, or submits compliance information.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for your non-excludable consumer rights.

21. Limitation of Liability

To the fullest extent permitted by law, CribNosh shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, business, or data arising out of or in connection with your use of the Platform.

Subject to the paragraph above, our total aggregate liability to you for all claims arising out of or in connection with the Platform or these Terms shall be limited to the greater of:

  • the amount of fees you paid to us in the 12 months before the event giving rise to the claim; or
  • GBP 100.

This clause does not affect mandatory consumer rights or any non-excludable statutory protections that apply to you.

22. Changes to These Terms and the Platform

We may change these Terms, the Platform, our features, fees, eligibility rules, rewards rules, creator rules, driver rules, safety requirements, moderation standards, or related policies from time to time.

Where legally required, we will provide appropriate notice of material changes. Your continued use of the Platform after a change takes effect means you accept the updated terms, except where applicable law requires another form of consent.

23. Other Important Terms

If any part of these Terms is found unenforceable, the rest will continue in effect.

If we delay enforcing a right, that does not mean we waive it.

Rights or obligations that by their nature should continue after termination will continue, including provisions on payments, disputes, liability, intellectual property, content licences, retention, moderation, fraud prevention, legal compliance, and governing law.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms, except that we may bring proceedings in another competent jurisdiction where necessary to protect our rights or enforce these Terms.
