1. Scope

These Driver Terms apply if you apply to, onboard for, access, or use CribNosh as a Driver or delivery partner.

These Terms supplement the main CribNosh Terms of Service, Privacy Policy, Refund Policy, Community Guidelines, payout rules, and other operational policies we publish for Drivers.

2. Independent Status

You are an independent contractor or business and not an employee or worker of CribNosh merely because you use the Platform.

You are responsible for:

  • your taxes and filings;
  • your work rights;
  • your vehicle, equipment, and operating costs;
  • your insurance and licensing; and
  • your own legal and regulatory compliance.

3. Eligibility and Documents

You must be at least 18 years old and maintain all licences, permissions, insurance, and eligibility documents required for your activity.

You must provide accurate, current, and complete information, including where relevant:

  • identity details;
  • licence details;
  • insurance details;
  • vehicle details;
  • bank or payout setup details; and
  • any other documents or declarations reasonably required by CribNosh.

4. Delivery Conduct

You must deliver safely, lawfully, and professionally.

You must:

  • comply with road, traffic, and public-safety laws;
  • follow reasonable delivery and handoff instructions;
  • maintain a reliable and safe method of transport;
  • handle food orders with reasonable care;
  • communicate honestly through Platform tools where required; and
  • treat customers, creators, staff, and the public respectfully.

5. Location Sharing and Operational Signals

Some delivery features require live, recent, or background location sharing.

By using driver features that depend on these capabilities, you agree that CribNosh may use location and operational signals to:

  • assign deliveries;
  • route deliveries;
  • track fulfilment;
  • investigate delivery issues;
  • review fraud or safety concerns; and
  • support proof-of-delivery, support, or payout workflows.

You must not misuse location permissions, spoof location, or interfere with tracking needed for lawful delivery operations.

6. Proof of Delivery and Exceptions

You may be required to provide proof of delivery, handoff confirmation, issue details, photos, notes, or other supporting evidence.

You must not:

  • fabricate proof-of-delivery;
  • falsely mark a delivery state;
  • falsely report a handoff;
  • hand orders to an unauthorised person where the order flow requires otherwise; or
  • conceal a failed or unsafe delivery event.

If a delivery exception occurs, you must report it truthfully and promptly.

7. Prohibited Driver Conduct

You must not:

  • operate without required documents or insurance;
  • use the Platform while suspended, restricted, or disqualified;
  • misuse customer or creator contact information;
  • take transactions off-platform;
  • engage in fraud, theft, abuse, or harassment;
  • tamper with orders or consume customer food;
  • falsify documents, evidence, or payout information; or
  • expose CribNosh or users to unnecessary legal, operational, or safety risk.

8. Payouts and Adjustments

Driver payouts may be subject to:

  • platform fees where applicable;
  • payout-provider requirements;
  • failed transfer recovery;
  • reserves;
  • refund or chargeback exposure;
  • fraud review;
  • compliance review;
  • negative-balance offset; and
  • other lawful deductions or adjustments.

Payout timing is not guaranteed. We may delay, pause, split, combine, reroute, or cancel payouts where risk, compliance, or payment-processing issues justify it.

9. Complaints, Disputes, and Investigations

CribNosh may investigate:

  • delivery complaints;
  • failed handoffs;
  • safety incidents;
  • fraud concerns;
  • proof-of-delivery disputes;
  • payout disputes; and
  • legal or insurer requests connected to your activity.

You must cooperate truthfully and provide reasonably requested information or evidence.

10. Restrictions and Suspension

CribNosh may warn, restrict, suspend, or terminate driver access where we reasonably believe there is:

  • a safety issue;
  • a fraud issue;
  • an eligibility or document issue;
  • an insurance or legal issue;
  • a serious reliability issue;
  • abusive conduct; or
  • another operational or reputational risk that makes continued access inappropriate.

11. Effect of Restriction

A driver restriction may:

  • block order acceptance;
  • block access to active delivery workflows;
  • pause delivery assignment;
  • pause, hold, or review payouts where contractually and legally permitted;
  • require new documents or verification;
  • trigger ongoing monitoring; and
  • lead to permanent removal from some or all CribNosh delivery services.

12. Appeals and Review

Some restrictions may have a review or appeal path. Where available:

  • deadlines may apply;
  • not every restriction is appealable;
  • evidence requirements may apply; and
  • reinstatement may depend on documents, explanation, remediation, or further review.

13. Indemnity

To the fullest extent permitted by law, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to:

  • your road use, driving conduct, delivery conduct, or unlawful acts;
  • your failure to maintain documents, insurance, or legal eligibility;
  • your fraud, misuse, or breach of these Driver Terms, the main Terms, or applicable law; or
  • injury, property damage, fines, enforcement action, or third-party claims caused by your conduct.
