Food Creator Terms

1. Scope
These Food Creator Terms apply if you apply to, onboard for, access, or use CribNosh as a Food Creator.
These Terms supplement the main CribNosh Terms of Service, Privacy Policy, Refund Policy, Community Guidelines, payout rules, safety rules, and other operational policies we publish for Food Creators.
2. Independent Status
You are an independent business or contractor and not an employee, worker, agent, or franchisee of CribNosh merely because you use the Platform.
You are responsible for:
- your business operations;
- your taxes, filings, and records;
- your labour arrangements;
- your local registrations and permissions; and
- your own legal and regulatory compliance.
3. Eligibility and Onboarding
You must be at least 18 years old and legally able to prepare and sell food in the relevant jurisdiction.
You must provide accurate, complete, and current onboarding information, which may include:
- identity information;
- business or premises information;
- kitchen or approved-location details;
- bank or payout information;
- food-safety, hygiene, training, insurance, and registration evidence;
- menu, ingredient, pricing, and allergen information; and
- any other declarations or evidence we reasonably require.
4. Food Safety Responsibility
You are solely responsible for:
- lawful sourcing, preparation, cooking, cooling, reheating, storage, packaging, transport, and sale of food;
- allergen management;
- truthful ingredient and dietary information;
- lawful labelling;
- temperature control;
- hygiene standards;
- shelf-life and suitability decisions;
- food-safety incidents connected to your food; and
- any harm caused by unsafe, unlawful, contaminated, mislabelled, or misrepresented food you provide.
CribNosh may require evidence, checks, declarations, logs, or remediation steps, but those checks do not transfer food-safety responsibility away from you.
5. Approved Premises and Location Controls
You may only prepare, store, or sell food from premises, kitchens, or locations that are authorised under your account and permitted by applicable law and Platform rules.
You must not:
- sell from an unapproved premises or location;
- move production to a different location without required approval;
- evade approved-location or geofencing controls; or
- misstate where food is prepared, stored, or handed off.
6. Menu and Listing Accuracy
You must keep your listings truthful and up to date, including:
- menu descriptions;
- ingredients;
- allergens;
- portion information;
- pricing;
- availability;
- preparation times;
- photo and video representations; and
- delivery or handoff representations.
You must not materially misrepresent the food, its source, its quality, its compliance status, or your identity.
7. Readiness, Spotchecks, and Evidence
CribNosh may require:
- readiness checks before you go online;
- spotchecks;
- document refreshes;
- food-safety confirmations;
- premises reviews;
- incident responses;
- corrective action plans; and
- supporting evidence, including photos, logs, declarations, or attestations.
You must cooperate promptly and honestly with these requirements.
8. Operational Duties
You must:
- fulfil accepted orders accurately and on time where reasonably possible;
- use safe and lawful packaging and handoff practices;
- cooperate with customer support, fraud review, and safety investigations;
- respond appropriately to stock issues, ingredient issues, and inability to fulfil;
- preserve relevant records where reasonably requested; and
- not go online when you are unable to fulfil safely and lawfully.
9. Prohibited Creator Conduct
You must not:
- provide false, incomplete, expired, unverifiable, or misleading documents or declarations;
- provide false allergen, ingredient, dietary, hygiene, training, insurance, identity, or premises information;
- substitute items or ingredients in a misleading or unsafe way;
- manipulate reviews, ratings, promotions, creator incentives, or platform metrics;
- take transactions or customer relationships off-platform to avoid fees or controls;
- sell while blocked, suspended, restricted, or under review in a way that prevents selling;
- fabricate evidence, logs, or proof relating to food safety, fulfilment, or support cases; or
- use the Platform in a way that creates unreasonable safety, legal, or regulatory risk.
10. Payouts, Fees, and Adjustments
Creator payouts may be subject to:
- service fees;
- selling access fees;
- reserves;
- chargeback recovery;
- refund recovery;
- fraud review;
- compliance review;
- payout holds;
- tax-related adjustments; and
- other lawful offsets or deductions.
Payout timing is not guaranteed. We may delay, split, combine, pause, or cancel payouts where there is a failed transfer, negative balance, risk exposure, or unresolved compliance issue.
11. Reviews, Complaints, and Investigations
We may review customer complaints, food-safety issues, chargebacks, support cases, report flows, and legal claims connected to your activity.
You must:
- provide truthful responses;
- provide requested evidence where reasonably required;
- preserve relevant records;
- cooperate with insurer, regulator, or legal inquiries where appropriate; and
- not retaliate against customers, drivers, staff, or reporters.
12. Restrictions, Suspension, and Removal
CribNosh may pause, restrict, reject, remove, suspend, or terminate your creator access, listings, orders, content, discovery placement, or payouts where we reasonably believe that:
- you failed onboarding, verification, readiness, or document requirements;
- you breached food-safety or lawful-sale obligations;
- your premises, location, or compliance posture is not acceptable;
- you ignored spotchecks, remediation steps, or investigations;
- you created serious customer safety or reliability issues;
- you engaged in fraud, abuse, circumvention, or policy breach; or
- continued access would create safety, legal, operational, or reputational risk.
13. Effect of Restriction
A restriction may:
- prevent you from going online;
- stop you accepting new orders;
- remove or limit your listing visibility;
- disable creator tools or seller workflows;
- pause or reject verification;
- pause, hold, review, offset, or reverse payouts where contractually and legally permitted; and
- require corrective action before reinstatement.
14. Appeals and Reinstatement
Some creator restrictions may have a review or appeal path. Where available:
- deadlines may apply;
- evidence requirements may apply;
- not every restriction is appealable; and
- reinstatement may depend on remediation, new evidence, or ongoing monitoring.
CribNosh is not required to reinstate a creator account simply because an appeal is submitted.
15. Indemnity
To the fullest extent permitted by law, you will indemnify and hold harmless CribNosh and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees arising out of or related to:
- your food preparation, storage, packaging, labelling, allergen handling, transport, or sale;
- your breach of these Food Creator Terms, the main Terms, or applicable law;
- your inaccurate, false, misleading, or expired submissions or evidence; or
- death, injury, illness, contamination, property damage, or regulatory action caused by your food or business operations.
16. No Safety Certification by CribNosh
CribNosh may collect documents, conduct readiness checks, or apply operational standards, but this does not mean CribNosh certifies, guarantees, or insures that your food is safe, lawful, or suitable.
